Obviously, given the scenario and because I have a child, I would save the child - but not for lack of caring for the animal. I know many people, who don't have children of their own, or who have pets they consider to be their children, whose opinion may not be the same. And because the animal would more likely than not die, I would mourn its loss as much as I would a child because I value the lives of animals as much as I do people. Just because others don't have as difficult a time holding animal life to the same level as human life as you do, don't discount them and take your "mighty then thou" attitude.

I don't believe I have intimated that you approve of the man's actions at all in my posts. You just have a different opinion than many. That's what makes the world go 'round!

I dont have to do anything.The idiot shot himself.Thats one for fido.Also K-9's are cosidered peace officers and will be prosecuted as such if one is harmed and guess what, they are a dog.They even go as far as making bullet proof vests to protect them as i would wear one to protect myself.Who knows some day a dog could save your life or loved ones from some ignorant piece of trash.And no im not a K-9 officer and never have been but i do know they are responsible for catching a lot of criminals :D
 
Ok, you got me on the K-9 part, but that is an exception...an exception I agree with, just because the dog is a major part of law enforcement...and should be giving some kind of protection to make criminals think twice about harming them.

You still didnt answer my question though, probably because he answer is no, you cant shoot the guy for beating the dog to death..even if he is the process of it.

Arent the guidelines for using your gun something along the line of...if you feel your life is in danger or another HUMANS life is in danger...then you may use lethal force. I wonder why this is, probably because human life should always be held on a higher standard than an animals.

You are right here...you can't shoot the guy..at least not without getting a hefty prison sentence. You can bet I would pound him within an inch of his life though....and the officer would get a story about how I intervened to help the dog and he pointed the gun at me so I dropped him.

I think you are right on the life endangerment thing...you can only use "reasonable" force. The life standard thing is an opinion...

Yep your right on that.Thats about what the law says.You would basically have to use verbal persuasion.If he does not obey orders then it escalates to less lethal force i.e. pepper spray but at the same time this guy was beating his dog with a gun.At anytime he points that gun at me and is refusing orders to drop the gun and comply my life is threatened by his actions to justify the use of deadly force.

But the unique thing in this case is that this guy shot himself.I cant say i feel sorry for him.I feel bad for his family as they are the ones are suffering cause of his stupidity.
 
animal abuse got you the max. No deals, no plea bargains,
no nothing. Plead on the nose or go to trial. My recomendation
was always max jail time and my judge usually gave it.

People that abuse animals are the scum of the

Negative. Not in Florida anyway. Yes you have the right to protect yourself but you MUST retreat first if threatened. The only time this does not apply is in your home (castle doctrine).

In this particular scenario you would go to jail because you basically started it (assuming you produced your weapon as part of trying to stop the guy). As I understand florida law, you can use deadly force in 3 situations:

1- Protect your own life (retreat clause applies)

2- Protect another human life (retreat clause might not apply but it would depend on the situation)

3- Prevent a foricible felony (sadly beating the dog would not qualify for this)

Florida firearms laws are among the most liberal so if you can't do it here you likely can't in most places.
