Negative. Not in Florida anyway. Yes you have the right to protect yourself but you MUST retreat first if threatened. The only time this does not apply is in your home (castle doctrine).

In this particular scenario you would go to jail because you basically started it (assuming you produced your weapon as part of trying to stop the guy). As I understand florida law, you can use deadly force in 3 situations:

1- Protect your own life (retreat clause applies)

2- Protect another human life (retreat clause might not apply but it would depend on the situation)

3- Prevent a foricible felony (sadly beating the dog would not qualify for this)

Florida firearms laws are among the most liberal so if you can't do it here you likely can't in most places.

What about beating him mercilessly? Would you wind up in the slammer for that? I was counting on some leniency...either from the arresting officer or from the court when they find out it is my word against his (me being a somewhat upstanding citizen and him being a dog beater). I don't think it would take Cochran to spin that one in my favor...
 
So sadly, we don't get to decide whether we can shoot him or not because it would just bring a rainfall of legality upon our own selves. But we digress from the facts of the story in that HE SHOT HIMSELF!

What are the laws concerning the shooting of trolls? Are they animal, vegetable, or mineral?
 
Well, I once broke a guy´s nose because he kicked my at that time 3 month old dog so that her ripcage broke. Should I regret that? I definetly don´t. That has nothing to do with taking animals more important than humans but with innocence and cruelty.
What happened to man with the gun keeps me believing that fate is fair, sometimes.
