I have displayed no trolling actions on this particular thread so therefore I am being judged by other threads.

If Judge Ito was around, this would be thrown out on the basis of a tainted jury.

SP, I am not arguing/debating or forgetting that this guy shot himself....I am just struggling with the fact that their are alot of people out there who think he deserved to die anyway and that he got what he deserved.

There is no doubt that this guy was an idiot. Like you said, he had a loaded gun beating the dog. Atleast he could of unloaded it first...geez.


You cant compare the life of an animal to the life of a human...our law supports this.

Exactly. And that's one of the major problems. If there is one thing that gets me _really_ pissed off, it's hearing about the dog that was put down 'cause he bit the kid that was hitting him with the stick.

As far as the issue in debate... Those that know me know my strong feelings on natural selection. So I'm just staying out of this one [for now].
 
Jeff - You are misreading that quote I think. He is saying its ok to put the dog down because the human is more important! That is what I have the problem with.

Negative. Not in Florida anyway. Yes you have the right to protect yourself but you MUST retreat first if threatened. The only time this does not apply is in your home (castle doctrine).

In this particular scenario you would go to jail because you basically started it (assuming you produced your weapon as part of trying to stop the guy). As I understand florida law, you can use deadly force in 3 situations:

1- Protect your own life (retreat clause applies)

2- Protect another human life (retreat clause might not apply but it would depend on the situation)

3- Prevent a foricible felony (sadly beating the dog would not qualify for this)

Florida firearms laws are among the most liberal so if you can't do it here you likely can't in most places.

You are right to a point.That also applies here but it depends on the circumstance.Is anyone else endangered by his actions,is it taking place in a crowded area or is he home alone.If it is happening in a crowded place where other lives are in danger your gonna have to intervene and that also depends on the officer as we have seen in some of the school shootings where the officers and supervisors did not take immediate action citing officer safety as an excuse.Im not gonna bad mouth them as i was not there.If the guy is home alone or isolated then its a different story.We could guess all day long,do you have probable cause to make an entry,is there any one in the house besides him.If he is alone, do you set up a perimeter and go to a barricaded subject and conitinue verbal commands for the subject to come out.It could very easily turn into a negotiation and swat mission.As you gather information you do what is needed following guidelines set in the penal code and your departments use of force. As we all know the system is getting way more liberal which has bad points and good points.Also in the headlines is the officer that shot that families dog.Once again i wasnt there but to me that was plain wrong.When making a decision you have to always keep in mind if a jury of your peers will justify your actions.

I think you are trolling here with the intentions of getting people on your side. I would appreciate it if you would actually read my posts. For example, here are some pasts quotes from myself in this very thread... Lets see if you can read these....
