Colregs do not use the term "right of way", boats are categorized as "stand on" or "give way". The stand on vessel is required to maintain course and speed but remain ready to manoever if necessary. Both captains are to blame in this incident, (not necessarily equally). The clip is a bit short to determine what led up to the collision, there may have been a reason that the give way vessel did not move i.e. if the stand on vessel had changed course or speed.
