The sailboat was not under sail, therefore was a powerboat under the
colregs. In fact, if you have the sails up AND are getting propulsion from
the engine, you are a powerboat under the colregs.

Chuck, you're spot on.

Colregs aside, doesn't this look like some fool who chartered too much boat and then let some nincompoop (possibly himself) take the helm? I've seen this before--frozen glassy stare, "this isn't happening to me," no change in power, but the wheel hard over in precisely the wrong direction.
