Have you heard? Sounds like contingency fee litigation is seeping North of the border. I guess we have Global warming to thank for that - if only tropical temp water could come with it. Time for a career change, great growth potential I imagine in the litigation biz.

Now I've done it, goaded a gaggle of lawyers. ...

You might try a search of dockets referenced to any of the major dive agencies via PACER or the state and federal docket search features of LEXIS. Of course no good can come from this . . .

Did a search using the ALLFEDS database in Westlaw. Search term was "PADI". Got 13 hits. Here are a couple.

Nova Designs, Inc. v. Scuba Retailer's Association 202 F.3d 1088 (9th Cir. 2000). Anti-trust case in which PADI was involved where the plaintiff claimed a conspiracy to deny him access to scuba gear market.

Olivelli v. Sappo Corp., Inc. 225 F.Supp.2d 109 (D. Puerto Rico 2002). Wrongful death case involving a PADI waiver. The Court held that admiralty law, not substantive law of Puerto Rico, governed a claims arising out of an off-shore boat dive. And the best part for the instructors: Liability release and express assumption of risk executed in connection with scuba diving lessons was valid and precluded dive instructor and his employer from being held liable for death of pupil due to air embolism; waiver was not ambiguous, did not violate public policy served by the application of general maritime law, and was not a contract of adhesion.
