Question Faber sold in Europe can't be tested in the US?

I had a similar circumstance and try to avoid cash transactions wherever possible, even if it costs a little more for the buyer protection.

I bought a used Dive Rite doubles wing on eBay that the seller said they bought used, and while they hadn't actually dove it, it would be perfect for diving doubles - and then went on to list the basic Dive Rite sales info.

Unfortunately, after I received it and was testing the bladders and found a problem with how they were connected to the dump valves. I contacted Dive Rite and they suggested that someone did a bad replacement and recommended I not dive it.

Seller refused a return since they said "they had never dove it", but PayPal agreed me with since they also described it as "perfect for doubles" and which the manufacturer said it was not in the current condition.

PayPal refunded my money, but like your situation I suspect the seller knew all along, and without the buyer protection I would be out of luck in an out of state transaction. So the few dollars it cost me was well worth it.

It is really unexpected that this guy would act like that.
Looking further into the guy.
He even seems to be a decorated Veteran that has served in ISAF in Afghanistan for over a year..
Otherwise Firefighter and Hunters Education Instructor..

All activities you would not expect a fraudulent character.
Unless it is all made up.

Well maybe he was too long in a war zone and that's what tainted his character..
Who knows. If he likes to dive and now is shunned he will sure regret to have made that poor decision.

The divemaster, that suggested that I should be fine filling untested tanks with a private compressor, if I happened to own one.

He may be all those things, or not, I don't know. The way he handled this situation makes me lose respect for him once and for all. As I said to him personally several times, what he's doing shocks me. He seemed unphased, claiming he's done nothing wrong.

If you are taking this to (small claims) court, or worse, then it would be wise to just stop posting publicly about the issue. It can only hurt you.
 
If you win, you get a judgement. Then good luck collecting on that judgement. Been there.

Where I live, the filing fees would probably be more than half of what the tanks are worth. Plus the process is a huge time suck.
Wage garnishment is super simple around here. And the OP is entitled to filing fees.

Lol.. that just shows that a Divemaster is not equalling a well educated diver. Divemaster is soley focussing on leading dives and to brainwash/entice folks into getting Instructors for the sole purpouse of the organisation. Pay Another Dollar In

or not could be the case as well. Some of the stuff he has on his linked in does not seem to add up. the service medal, times, coinsciding with his firefighter status as catastrophy reserve (similar to army reserve but a civilian concept). I looked into if Germany ever delpoyed such reserve to Afghanistan and ISAF which I couldn't find any evidence. Might still be true, but usually folks are in the military or in that reserve and not both and I have never heard of being in boith at the same time, but that's what it would have to be from what he posted on his profile. So who knows, he might just be a total different person he claims to be to begin with.

Well that's where human psycology kicks in. Could simply be a case of confirmation bias. As stated beforte he genuily might believe he is right without even recognizing what a ****** person that makes him.

What I'm mildly curious about, not that it changes anything in the situation between me and him, is if the people that sold him the tanks had any idea that they were unusable in the US.

It appears, it was a German couple, who spent last three years sailing on their boat in the Caribbean. Since the tanks are clearly from Germany, I doubt that they shipped them from Germany to the Caribbean, then flew in, and rented or bought a boat. So likely they sailed all the way from Germany to the Caribbean in their sailboat, then spent 3 years there, then sailed to Rhode Island, where they sold all their equipment, before returning to Germany. Now, that's an interesting story.

When a book is written or a movie is made about the adventures of these people, these tanks could be a good piece of memorabilia to hold on to, if nothing else :p
