Question Faber sold in Europe can't be tested in the US?

He surely got the message by now. 5 is really terrible though! It is the climate these days, but also does not make it right nor are the folks doing those threads any better than the fraudster in my opinion. 1-3 is fair game, 4-5 is also wrong.. Especially 4 is also something that gets more common falling in line with the whole cancel culture attitude which is not a good path. The mix between personal and professional life is not a good thing. I might not like someone on a personal basis, if the person is acting professional in their professional life and does a good job there I would always still deal with such an individual.

I agree and that's why I made it clear to a few people that suggested it, that I will never go to his employer.

I personally wouldn’t contact someone’s employer for a private dispute, but if someone’s relationship with a business is widely known and that person is behaving badly, even if outside of work, it can affect the employer’s reputation and business.

There are many instances of people losing their jobs because of incidents unrelated to their work. Employers are entitled to dismiss employees who bring their business into disrepute even if the employees behaviour is not connected to their work.
 
I'm not inclined to make any generalizations about his country of origin. I have great friends in Germany, including divers.

What makes this story worse, he lives in the same town, where lived for 10 years. His kids go to the same schools as mine went to earlier. After he took my money and we loaded the tanks in the trunk of my car we had a chat about the town, the schools, and so forth. He shook my hand before he parted. German or not, this is just not an honest, ethical person there. And it sucks.

As to the tanks, they do look like they've never been rinsed, yes. The German visual inspection stickers on the neck (not seen in the pictures) have expired in 2022. Still these are less than 5yo steel Faber tanks, good be good tanks with a lot of life left in them. If I'm stuck with them, I will consider ways of moving them to Europe, so stay tuned, and thank you for the offer and your input.
Oh I guess I should have checked the pics better, so they are less than 5ys old at this point? Well sure than it is worth looking into options. Also at the price you paid it might be worthwhile diving deeper into the topic of getting them legally re-stamped as DOT tanks. I know there is a process. as stated before you will need burst disc valves though and there I am not sure if you can get those as M25s, but that should be easy to figure out.
Yes I think I found the guy on linkedin and from that profile I would never have guessed that he would play such a game, given all his background you would actually expect the exact opposite.
Surely he did not like that he bought those tanks without paying the proper attention but then trying to pass that mistake on to someone else while telling a lie about the history of the tanks is just super low. Especially as one would think he should be able to afford the loss as ex-pat and plant manager and he should also have options to bring them to use or sell them towards Europe.
Quite a low decision.. he now with all the backlash is probably just trying to justify to himself that he wasn't wrong as otherwise this would affect the ego.
So he likely even believes (by now) that he is right.

I am aware of that. I just personally think that such practise is wrong and should not be supported.
 
The damages I'm seeking is $350. The filing fee is $40. I gather if I win, he owes me $390.

well at least he'd have proof that he was right even if in fact it'd turn out the way you suggest.
And the seller would have it in writing that in fact he did something wrong, which he currently claims (and likely even believes) he didn't.. To me that would already go a long way.

A few years back I bought an italian made electric scooter via their German importer in Germany.
The thing never worked and after several back and forths I wanted to undo the deal which was denied by the seller, so I took it to court which according to the legal insurance (hence they were willing to cover it) and the lawyer a case as solid as it gets.
The court proceedings dragged out for 3 years and now the importer went bankrupt and thus the court ended the case with no ruling.
So I have nothing but an electric scooter that I paid almost 6K USD for that does not work at all.
Even if I would not have been able to get the money due to the bankuptcy I would still have appreciated the court to have ruled in my favor. Would have given me at least peace of mind which would soften the commercial loss.

Well, not quite. Unfortunately for him, he picked a very wrong person to mess with. Very wrong.

He came into the area 1.5 years ago, according to the date he purchased his house. I don't know if he came from Germany or Arizona, and I don't care.

I lived here for 24 years. Dove for 20 of them. 10 in the town he lives in now. It's a 15k town where I know dozens of families. I'm still thinking whether I should go all the way and ruin his reputation in that town. It's been less than two days. He is already shunned from the diving community in the area. Being known as a douche in town would pretty much ruin him. I can easily make it so he never is able to get a fill in both of the dive shops in the driving distance. All for $350 he defrauded me for.

I think there is a story here for people to learn from. Myself included.

UPD: by "not quite" I mean I'm capable of a lot more damage that has been done to this point.

Well you state it yourself.. All for $350.. So while I get your frustration I think also the reaction should be measured to what the damage is. Would ruining his life over this make you much better than his acting?
I'd suggest don't do that and rather take the moral high ground than getting in the ditch.
I think there is a story here for people to learn from. Myself included.
See you said it yourself again! ;) Learn from it. I think being shunned from the diving community is plenty enough penalty for that magnitude of damage ;)
