Forgot to ask - if you are freediving with mask, snorkel, wetsuit and fins are you exempt from the diving flag law as long as you have no tank?

To be safe, yes I would bring a dive flag when freediving since you are still diving.
I hope you read all the other posts about Flori-duh boaters

nope:

(a) "Diver" means any person who is wholly or partially submerged in the waters of
the state and is equipped with a face mask and snorkel or underwater breathing apparatus.

Fla. Stat. 327.331(1)
