If you hear a boat, or see prop wash, just make sure you are hugging the bottom. Sometimes they will even drop anchor near ya!

To be safe, yes I would bring a dive flag when freediving since you are still diving.

nope:

(a) "Diver" means any person who is wholly or partially submerged in the waters of
the state and is equipped with a face mask and snorkel or underwater breathing apparatus.

Fla. Stat. 327.331(1)
