Looks like construction has started to expand the pens.

From todays Por Esto news:

New and controversial construction

COZUMEL, October 14 .- Presumed expansion of the facilities of a company dedicated to the interaction of tourists with manta rays generated controversy in social networks, because they would be expanding their infrastructure on federal space where it is assumed that there are conditions to build and you would be losing some meters of public beach where people already went to freshen up.
This Saturday, workers of the company that owns the captive manta rays, reported that an expansion of the facilities was being carried out. Outside of that federal estate was a document, with data on it, it appears that the building license was delivered by the city council under number 17/9 / 581AMP, effective September 27, 2017 to conclude on the same date but the year 2018.
It was established in the document that the promoter is the company Coco Real del Caribe Sociedad Anónima Capital Variable, located at kilometer 2 + 350 of the southern coastal road, with the definition that the work consists of the expansion of the park Lum-Ha Stingray Beach Cozumel (palapa and pier).
At the moment some foundations have been constructed, one of these on the rocky layer without leaving the 25 meters that should exist from where it breaks the last wave.
The Local Ecological Management Program (POEL) states that "the modification of the coastline is conditioned to the presentation of scientific evidence in the Manifestation of Environmental Impact that demonstrates that such constructions will not have an irreversible negative impact on wetlands, pastures marine, reefs, and the area of micro-atolls, which could cause ecological imbalances and environmental conflicts, "it was not known if there was a delivery of this document.
The area where this expansion takes place is located on the south side of the manta ray business and the controversy took place in social networks where people criticized that they would miss another portion of the public beach in Cozumel.

that has to be a mis interpretation. Mantas are way to big for there. I'm pretty sure it should say Sting Rays
