Being that it was crew who got the passengers sick, and because of that they missed a decent percentage of the activities they paid to do, I think some compensation is in order. How much? I don't know, not a free trip but a little something.

OTH a letter like the one the OP wrote? Not a good starting point and would most likely turn off any interest in friendly relations from the buisness perspective. I think both sides are wrong. I'd still dive with EV though. It's not like the boat sank or anything...

Randy: Quite missleading to say the least.

Below is a excerpt for my 1st e-mail to McCardell:

In order to compensate Carol and me for getting us sick and for the 31 dives we missed, we believe that Explorer Ventures should do the right thing and issue us a cash refund. We have decided not to include the $340 in tip monies or the other associated fees paid and only work off the base amount of $1,695 each. We realize a part of the fee includes meals and lodging, but for simplicity, I propose we use the total number of possible dives for these calculations. There were 27 possible dives. $1,695 divided by 27 is an equivalent of $63 per dive.

The value of Carol’s nine dives is $567. The value of my 14 dives total $882. Combined, the value of the trip for us was $1,449. We paid $3,390 for the two of us and when $1,449 in value is subtracted, our loss is $1,941.

Please advise how you would like to handle this transaction.

You say this is an excerpt. I would be very interested in seeing the full text of this initial correspondence you sent to Explorer Ventures regarding this issue. It would be helpful in determining the overall approach and tone you took so that we could gauge why EV reacted the way they did.
 
I think that some of you are weak. I read some of these blogs and wonder how I can get your bank account numbers. If i rip off all your money You might thank me later.
If I or most of you had planned this dive trip and paid out $4000+ just to get sick from the crew and staff. I would make a lot of noise until I was compensated or they lost customer base.
I work hard for my money and take my vacation time serious. This charter company got you money and dumped on you. And people say well the boat did no sink so stop crying. I say yell louder and send emails to everyone whom has a address. This charter will want you to leave them alone and beg you to stop.
 
Don - While you are waiting to find out if EV is going to enter into any realistic negotiations of an equitable settlement, I'd suggest you go ahead and calculate your total cost for the trip including tips, air fare, and the cost of vacation from your job(s). This number may be a better basis for determining your loss involved in this trip in case you are unable to arrive at a mutually agreeable settlement. You might also suggest your fellow tavelers who suffered similar losses do the same.
 
I would definitely demand a full refund if the boat sank....:D

sadly, there has been precedence that refunds aren't given even in that occurrence....



BTW.... I voted YES also. As I've been on a liveaboard where we've had problems before caused by the boat owner and I understand the frustration.

In this case, I think the OP could have gone about requesting some form of re-embursement in a better way, but at the same time, I think this whole thing could have been prevented by the Boat operator taking off the sick crewmember. It was having sick crewmembers that caused this whole problem, remember.

It just appears that the whole thing could have been handled better....
 
I said yes to the compensation based on the comments. Not because the crew was sick but because it appears they did not do all they could to minimize the impact such as proper cleaning and sterilization practices etc. A ship is a small confined space and without aggressive measures the recurrence of the illness is that much worse
