Anyways....in further evidence of the urban legend of 'injure a mexican while driving a rental car'.....

This I hope is a rational explanation on what we are trying to resolve pertaining to lost wages for Mexican Nationals hurt in accidents off the workplace and Rental Vehicles liability limits and to when that financial responsibility terminates.

From what I have gathered. The legal responsibility in terms of liability should have ended when all medical and auto/motorcycle repair payments have been made by the insurance company to the victoms.

Reason being, is that if the injured party had current gainful employment by a Mexican Company, and which were enrolled in the Social Security System of Mexico (Instituto Mexicano del Seguro Social (IMSS) and or Institute of Security and Social Services for State Workers (ISSSTE)

These Mexican entities would have picked up the portion of a Lost Wages claim as per Mexican Law. Mexican Law dictates as so in the following:

Article 123 of the Constitution and the text of the XXIX fraction was as follows:

"Public utility is the Social Security Act and it shall include disability insurance, old age, life, involuntary unemployment, sickness and accident, childcare and other aimed at the protection and care workers, farmers, non-wage and other social sectors and their families. "

Medical assistance, through institutional medicine, protects the public when any member becomes ill or suffers an accident, providing curative and rehabilitative services.

Thus, as Social Security contained in Mexican law provides for compensation of workers with some means of subsistence when one is deprived of remunerative work for the result of Sickness or an Accident resulting from both the work and for reasons not related to it.

Therefore, in order to be eligble for Lost Wages in Mexico, the mexican National has to be Lawfully and currently Employed, (Not Under the Table Work) and thus pay into the Mexican Social Security System by his Employer, and or privately participate themselves financially in order to receive monetary benefits.

In this case, Mexican Law was apparantly not adhered to. Was proof given to the Pastor that the injured even had stable employment in Mexico? There should have been some sort of acknowledgement of IMSS or ISSTE Coverage by the victoms. The problem was that the Pastor had no Legal Counsel present for his defense. That would be the main target to investigate when renting a vehicle here. Search to see if the rental coverage includes legal representation from a Mexican Attorney if detained?

So there you go. I hope that this gives you confidence that there is a system out there, although it being kind of vague, that if properly adhered to, should not land you in Jail. The Legal Counsel of the Victom had no resistance, filed a motion to get some quick cash, Welcome to the legal system.

Good luck in your future rentals, and hope that this sheds some light on this whole confusing system.
 
Like I said deepsea, give me the 40-50 examples of other people being jailed for injuring a mexican while driving a rental car....surely if this is for real there should be literally hundreds and hundreds of personal stories out there...

all the ones I have ever found all site the pastor's fictitious story and nothing else.

MMM... I've shared info that is factual and I am now done with this tread. There are always those who raise a stink and care to challenge everything. If you think all that I have posted is a joke so be it. You aren't going to find 40-50 examples of this just as you won't find 40-50 reports of dive accidents in Cozumel. They happen and you won't read about them via an online search.

Do you know that your link you posted as an example actually refers to the story I copy and pasted here from the pastor? You yourself have posted a link for an example of this issue that is an article that bases it's 'facts' on the pastor's fictitious story and nothing else. You see what I mean yet? Kind of crazy how everything all goes back only to that one web page. Where are other people's stories? Surely more than one person since 2011 has had a rental car accident that injured a Mexican?

I'm not sure if someone driving in Coz on vacation, ran someone over, went to jail and had to cough up a pile of $ to walk away from it would want to share that experience with everyone. I'm also not sure the local media that serves a local economy based on tourism (including scooter and car rentals) wants to report news such as, "Tourist who purchased all insurance available still pays $5K to get out of jail and go home".
 
By that logic, no one would ever tell their story about being conned or victimized. And "local" is relative. For example, an Atlanta paper would be quite keen to report such an experience that happened to an Atlanta citizen. Google hits news sources all over the world.

First off, this is supposed to be a Mexico law not a Cozumel law. The sampling size is car rentals for the entire country.
 
I was asked in a PM to comment on this thread.

The minimum wage in Mexico is used to calculate maximum liability damages in the case of an auto or moto accident that results in the death of a third party. Recently, that amount was raised to 5,000 times the minimum wage of 80.04 pesos, or about $20,000 dollars, plus funeral costs. The federal government also allows states to raise that calculation to 5 times that amount. In Quintana Roo, the calculation only comes to about $25,000 usd. In other states it is much higher. It is also good to remember that a judge can award “extra” damages if he feels the circumstances justify a higher penalty; for instance, if the driver at fault was driving recklessly or had any level of alcohol or drugs in his system at all. That is another good point to bear in mind; there is no “Legal Limit” in Mexico. ANY level of blood alcohol will void your car insurance if you are in an accident.

Victims of auto accidents in Mexico have a right to claim “Actual Damages” from the driver at fault. “Actual Damages” is defined as “damages based on the actual value of the other vehicle, plus damages resulting from lost wages, and medical expenses for the other driver or occupants of his or her vehicle”.

Quintana Roo mandates that all drivers have auto insurance. They do not require that you have enough coverage to handle every kind of incident. Not all car or moto rental companies in Cozumel have the same insurance policies or the same coverages. You need to read the policy and make sure it has enough coverage. Then, you need to make sure you don’t void the policy by driving after a drink, driving off-road (dirt roads) or having someone not listed on the policy drive the vehicle.

A new wrinkle is that, although the law has been unenforced for many years, PROFECO and the local government have been reminding rental agencies that it is the law that you must have a motorcycle license to rent a motorcycle. I would assume that would mean that having a wreck while driving a moto without having a motorcycle license could void your insurance as well. Time will tell how that rolls.

The 2011 Travel Advisor post by Chris K that included his caveat “From what I have gathered…” that was quoted earlier in this thread and stated that IMSS is required to pay lost wages to incapacitated workers is incorrect. IMSS does not start paying disability (not lost wages) right away and do not pay the actual wage the victim had at the time of the accident. To be made whole, he could demand these lost wages be paid by the driver at fault.

If you have an accident in Cozumel and someone or something is hurt or damaged, the likelihood is that the police will be called to the scene. You will need to either work out and pay a financial settlement with the injured party for the Actual Damages and get a signed agreement and receipt to that effect on the spot, or you will be taken to the police station to work it out there. If you have an insurance policy with the rental agency, they should send someone to the station to handle the settlement with the injured party so that you can be released. If the cost of the Actual Damage exceed the amount of your coverage, you will be held at the station until you come up with the difference in cash. If the insurance was voided because you were under the influence, you will be held at the station until you come up with the total cost of the Actual Damages in cash. If you can’t get your hands on enough cash (while being held at the police station) in a reasonable amount of time, you will be transferred to a holding cell until you do.
