This is not true as stated. I have seen kayaks show up on my radar. Modern radar is extraordinarily good. Much depends upon conditions, in 5 foot seas and light rain the dinghy will not show up.


The international rules for prevention of collisions at sea (COLREGS) require display of red over white over red all-around lights, separated by 2 meters, while divers are down at night.

I would hope emergency services would not be deployed to rescue any fools who might engage in such behavior

That should be a first responder rule. "Check if the person needing rescue did something stupid to get them in this predicament if so, disregard the call". It would save a lot of work and over time the gene pool quality will improve.
 
I had an 18' hard hull Oregon Dory that I built and used for diving for about 10 years before the great recession hit and I was forced to sell her.
I never got up enough nerve to solo dive off the boat. Too much can go wrong.
If I solo dive off anything it's my kayak now.
