but PLEASE leave out the personal attacks! They are counterproductive and do little to sway those of us who are reading this for insight. Some of you would do well to go back and edit out the meanness in your posts. Show us how clever you are with your sound reasoning and deep insights. Even a ten year old can hurl insults.

Would it have made a difference if it would have been an open boat instead of a club charter? I know the standards are somewhat different between a common carrier and a private carrier, but I am not a lawyer...nor do I dive on SASY. :D

I looked at your profile picture. Are you sure that you don't have a SASY in there somewhere??? You should consider it. I understand that some of the best and most experienced posters on this Board use them. Saves time gaining actual diving experience and lets them work on that PADI Cyberdiver specialty.

There are differences between common carriers and private carriers; however, I'm not sure that they would make much difference in this case. If this case were governed by U.S. law, it would probably come down to what duty was owed to the pax at each point in the voyage, whether the defendants' performed their duty and whether any injuries to the pax were a direct and proximate result of a breach of that duty. Of course, the defendants could raise the pax's own negligence, if any, as a way of setting off damages.

Before anyone starts in on me, I'm not taking sides in this issue. Even after reading up on the accident, I'll readily admit that I don't know enough to form an informed opinion as to negligence, liability or damages. The foregoing statements are simply a brief discussion of the general law of negligence.

When I don't show up for work people rejoice! The Internet is faster since I am not on scubaboard all day and people are more productive without me slacking off...
 
If you aren't slowing down your T1 you aren't posting enough on scubaboard... Get out from behind that stack of files and start posting!
 
Or I could upload our DIRF...we just got the tape and converted it to mpg. It is going to be about 2 CDs full...funny stuff!
