Thanks but I guess I should have been clearer. I am looking for the authoritative regulation (law) that says that I can not transport a scuba tank with an expire hydro across state lines. My understanding is that the DOT reg (don't recall specific #) prevents the commertial filling of such a tank bt does not regulate private transport or filling.

Specfic reference please.

It only applies to those that are charged, and I believe only if used for commerce. I.e. a dive shop can't drive from NC to VA with a trailer full of out of hydro tanks and use them before taking them to hydro, but a person can.

I found this in CFR 173.301:

(6) No person may fill a cylinder overdue for periodic requalification with ahazardous material and then offer it for transportation. The prohibition against offering a cylinder for transportation that is overdue for periodic requalification does not apply to a cylinder filled prior to the requalification due date.

But I believe this only applies to commertial transportation and am not sure how it would apply to a dive shop. I believe the commertial transportation of such cylinders has the carrier able to provide certaqin records including content and fill dates. I bet a dive shop just loads them up and has no such records.

Basiclly DOT regs allow a cylinder that, even if filled the day before the hydro was to expire,
be used or transported until empty, be that be the next day or 10 years from now. No time or transporation limits.

So the regulating agency allows transportation but the scuba police say it can't/must not be used???

that is the beauty of being the scuba police. you can make up any rules you want.
 
we do have to remember why the VIP was put into place, which is water being blown into the tanks for various reasons which industrial cylinders are not normally subject to. It's a good thing we have it, some people just tend to take it to the extreme
 
One point you guys are missing... he said VIP not hydro so all the talk about whether or not it can be transported...of filled for that matter ...is irrelevant. VIPs are a scuba industry "rule", not a regulation of a government agency, they can be ignored if one so chooses to do so. Not saying its a good idea but it's not a regulation that has any government sanction behind enforcing it.
