Does the customer run into that sign (condition) before or after the contract is set (money paid)?

Assuming it is after, does the boat offer a refund if the customer declines to comply? Maybe I am still on parole and must wear an ankle tracker.

But I do not see where any company [-]could[/-] should refuse a complete refund to a customer that saw that rule and decided they were unwilling to comply. The charter is in fact changing the rules by posting it only where the customer will see it after payment however I do not see as a big deal as long as both parties to the transaction operate in a reasonable and ethical manner.

To your second Yes however ther is legislation to protect the libraries from prosicution. They are not treated that samne as your home is. It was done for the purpose of making all information available to library users. This is a highly volital issue in the child preditor world where parents want protection from those who use the library to stalk ect. More than one atrticle has been public of librarians being fired for reporting that users are downloading kiddie porn on library computers.

Back to the first,,, i found that out when reporting a site to the FBI that was passing kiddie porn under the guise of unrelated file names. When the agent called me i offered to send them the file, he stopped me and told me that if i downloaded the file i was guilty of transfering kiddie stuff, and that as long as i only was in posession of the link to the file i would remain faullt free. That led into the liabilty of wireless users and security.

as for the first example. Do you know of an actual case where this happpened?

It seems to me that you are saying that when someone does anything illegal online, the ISP is also liable, or if they go to a public library to use their free computers, the library is an accomplice?

I think anyone who would do that is a complete butthead. I HAVE heard of it happening, however.

I can't think of any Capt. that's worth a damn, that hasn't been called a name by a malcontent passenger or crew member somewhere along the line. It goes with the territory.

I mentioned earlier that I normally leave my Blackberry in tracking mode and then transfer the output into Google Earth.
This weekend I was transferring the KML files that I generated during my dive trip over Xmas. This revealed an interesting twist and will form the basis for a refund request for one of the days.

The operator took us to a particular wreck, the briefing was done for this wreck, the name was up on the whiteboard on the boat. But now that I've plotted the track it's clear we were taken to the WRONG wreck.

This raises the question as to whether the operator deliberately mislead us or whether it was an operational mistake. There are 2 identical wrecks less than 1 mile apart and we had already done the sister ship just a few days earlier. They are 2 tug-boats that were sunk some years ago at the same time but as part of an experiment, one was opened immediately to divers while the other was kept off-limits for one year for comparison purposes to evaluate diver impact. The official report after 1 year stated that there was no observable impact from divers. I remember at the time thinking to myself that the 2 boats were in an identical state of marine growth.
I now know from my GPS log that we definitely dove the same wreck on 2 days.

Quite frankly, I consider it a rip-off when you contract a lot of dives and then dive operators keep going out to the same repeating sites. We went out on that day on the understanding that we were going to a different site or we would have used the credit on another day. We had already done the wreck 3 times and the daily rate was very expensive.
