You can do what I did, resell it on ebay, get what you can for it, and close your account.

The only thing I got consistantly on ebay was screwed.

I don't know what "Square Trade" is, but any companyy that wants more money from you after you already got hosed is not looking out for your best interest.

I bought a rechargeable Dive-Rite light on eBay that smoked and would have caught fire and burned my house down if I hadn't been working in the same room with it (the owner bypassed two fuses with wire).

There have been others, but I don't want to spoil my cheerful mood.

I wouldn't buy a $20 on ebay even if it were $10.

Really sorry to hear about your bum deals.... This is my only used peice of equipment so far. Probably stay that way. Between the class costs and all mt gear, I have spent a good 1k+ and as a student its hard. But, thats why I work my butt off! So I can plan every other weekend... hah. Boo to 50+ hours of work, 15 units in college, and trying to find time to have fun and hang with the Ms.

You've got to be kidding. It's called capitalism...and it works well for most of us.

Squaretrade, in fact, is a fine service that offers dispute resolution for ebay buyers and sellers. They alone have the ability to negoitate removing bad feedback from an ebay profile and consistently help people who have been defrauded on ebay. And yes, they charge a modest fee....

Getting screwed on eBay has nothing to do with capitalism. It's caused by their business model that allows people to sell items that may or may not exist, and may or may not be as advertised, with virtually no penalties.

Can you imagine if you were defrauded on a credit card purchase, filed a complaint with your bank and were told "Sure we can help you, just pay us."?

There are only two kinds of eBay buyers. those that have been screwed and those that will be.

My first step would be to tell the person how you feel, and hope he just made a mistake. You might be able to raise a stink with ebay or paypal but its most likely a waste of time. I wouldn't even bother with "Square trade" or trying meaningless threats. Its a tough lesson to learn, but at least it cost you only 300 bucks to learn not to do it again.
If I were you and lived in San Diego, I would maybe put an ad in the paper saying that I was looking to buy used gear. Theres a lot of military folks,mostly navy, not to mention local divers there and some might want to unload their gear on you for a few bucks before they ship out. That way you'd at least be able to see the gear before you paid for it.
I've never had a problem with sellers on ebay, but I also haven't bought life dependant type gear from an ebay seller. It just seems too much like trusting a stranger with my life.

I second the above from Redd - contact the seller direct. Most sellers will just say "send it back" and if you are close by maybe even meet in the middle to do an exchange. Filing a dispute is a last ditch. But I definately would not keep anything you are not happy with. I buy and sell on Ebay and have returned things and also refunded. Its not the end of the world. If he/she makes a fuss then you can file a complaint and just the filing will generally solve the problem because big sellers don't want bad feedback.

He just emailed me abck and apologized for the mistake and said he would give a full refund or let me have it for $75 dollars and refund the rest. I think I will just keep the BCD, depending on if I can get the plastic weight keepers from somewhere. No shop in San Diego carries these dumb things. And I was thinking about may sewing a vecro flap to go over the slot where the weight pouch goes, so that you will undo the velcro flap, then pull the rip cord to release the weights. This will prevent the weight pouches from getting lost. I hear that is a common problem on the bcd.

i have two questions, first does the bc fit very well, if it doesn't then return it. 2nd are you set on an oceanic bc? bc there are other deals to be had.

Yes, I put on on my wetsuit and all my gear and it fit well with a lot of room left to adjust for bigger sizes.
 
I have a BCD with these same weight pockets (actually it's my wifes Isla) but she put a lot of dives on the BCD with no problems. She literally wore it out. I can definitly get the little white keepers and so you should be able to quite easily. If the BCD fits and you can resolve the two small problems you have with the BCD AND the seller is going to adjust the price then you are in great shape, you're gold! Put some superglue where the seam is unravelling and one way or another we'll find you some weight pocket keepers-M
