According to the article, the DLNR retains authority over everything below water at Molokini. So, unless the DLNR changes specific policies regarding the islet, there shouldn't be anything different about diving there. Dive/Snorkel operators do not associate with anything above water, and it has always been illegal to trespass on the bird sanctuary.
 
So, as long as the The U.S. Fish and Wildlife Service is happy with the way the boat and folks behave, there should be no difference, right?
