So, how many customers who participated in the Luxfer Scuba Tank Return Program were charged state sales tax on the full price of the replacement tank rather than being charged tax on the net price?

If so, I think the the LDS owes you a refund. Since this was a trade-in program, it should work the same way as purchasing an automobile from a dealer and the trade-in value reducing the purchase price to a net price that the sales tax is calculated on. Even though the LDS didn't take the tank in trade, they are the authorized dealer that worked in conjunction with the manufacturer and should have only charged slaes tax on the net.

If you participated in this program, how were you charged?

That may be the way they calculate sales tax on a new vehicle in TX but unfortunately that ain't the way they do it out here in CA. I bought a 2003 F-150 on sale for $13,800. The list price was $16,500 or something like that and the list price is what CA used to calculate the sales tax.

Hell, in CA they even charge you sales tax on the free cell phones you get when when you sign up for a phone plan. CA charged me $15.50 ("list" price $200 X $0.0775) sales tax on a free phone.

From what I remember the voucher was like a coupon. It was used as partial payment for the tank. I don't remember seeing anything about the dealers lowering the price of their tanks. I could be wrong.

I'l grant the weather and the diving out there is midlin' decent, but is living there worth the hassle of dealing with the state bureaucracy? Around here that kind of "pay tax on what we think you should have paid for it" nonsense would quickly lead to some new politicians and bureaucrats, either through election or direct action.

IMNSHO Thieving bureaucrats and politicians are not lesser thieves just because they draw a govenment paycheck. If anything they are more culpable as they steal under the cover of the law!
 
I remember a cell phone deal in Ca because it is illegal in the state to sell something for less than a 3-4percent profit.
That locked up the cell phone give aways and dragged on for quite a while.

I had contacted the Texas Sales Tax Dept. and received this excerpt as a reply:

When coupons or certificates are accepted by retailers as a part of the
selling price of any taxable item, the value of the coupon or certificate is
excludable from the tax as a cash discount, regardless of whether the
retailer is reimbursed for the amount represented by the coupons or
certificate. The voucher acts as a cash discount, and sales tax is due on
the discounted purchase price for the tanks after the voucher amount is
subtracted.
 
Oh well. Based on your info and what my LDS sells tanks for I would have saved a WHOLE $4.00. I think I can let them have that.

The LDS didn't get to keep the $4.00. They remitted it to the state sales tax division.
 
OK, I'm going to ask a stupid question here (and then duck to avoid the shrapnel). What is this program? I just recently bought a used Luxfer tank from my LDS. Also, anyone know the Rosetta Stone for deciphering the tank stamp?
