What is this " COE " ? This is not a .comer--http://www.tpwd.state.tx.us/
On your last post which file is it that you are using to denounce it is a law?
Getting confused here, on your Texas code post what is your point?
The handbook feferanced is from TPWD website which is the one I noted above.

COE is corps of Engineers

TX law say that in order for divers to obtain the protection from boats they must fly a dive flag. That is: no flag gets you no protection under this law. But if you search the reg, you will not find a specific requirement to fly the flag per se.

The site http://www.boat-ed.com/tx/index.htm does not appear to be an official TPW site. The boating course it is presenting does appear to have a TPW approval.

Here is a federal code that requires the dive flag. Searching would uncover more.

I'm not trying to discourage anyone from flying the flag. Just trying to seperate fact from fiction.

Your correct, I did not see it stated as law you must fly a dive flag in the statue you posted but thats what it says on the website he originally posted that is found and accessed at the TPWD gov site and it carries the TPWD state logo on it. Now me not being a paralegal or student of law is a limiting factor as to doing research and even interpreting law I must say I am relying on my states website and links they provide to be accurrate and truthful plus several of us have first hand experiance of seeing that very law in action. I do not percieve it to be fiction at this point still, just to be a fact that you have not found yet and that I'm incapable of finding.

The boat-ed site links to TPW, but the link is not reciprocated. I could not find the referenced site on the TPW site, even under to topic of boater education. Did I miss it. And I wouldn't be too impressed by the fact that the boat-ed site had the TPW logo.

As far as the reported experiences go, Canyon Lake is a Corps lake so the flag is required. The corps cops as well as others are subject to enforce it. PK is a Colorado River Authority lake. If a diver was was flying a flag, TX law requires boats to give it way. Great to hear a Jetskier got cited. When I dive Stillhouse, I fly the flag because it is also a COE lake. But I tie it off and then try to get away from it as it can work like a boat magnet.
 
P.K. is under the BRA- Brazos River Authority. We have BRA rangers enforcing the law as well as Texas Game Wardens doing the same. I have seen and been checked by game wardens on COE lakes and BRA lakes, they can go on any body of water or plot of land and enforce the laws of Texas to protect animals and people.

Thanks, I see the link now. I guess it will be up to the judge to see how he enforces rules contained in links to external site.

Amazing how Brazos can change to Colorado in under a minute. Teach me to remember rather than copy. Yes, all the law guys can enforce any applicable laws. But your TPW warden can't apply a COE regulation to a BRA lake.
