On the matter I discussed with you, I have facts, dates, times, and numbers for all of it. I don't want to put my name on it, though.

I was not singling you out. I was stating what we see over and over with these type complaints. No one should expect that an agency punish a member on hearsay. I got a QA report a few months ago where the person reporting wanted to remain anonymous because he did not want to get involved. We can do nothing about that...:idk:

Surely you understand that we cannot and will not go on a witch-hunt without a formal complaint that we can confront the accused with. :no:
 
Absolutely. It's frustrating, but I definitely get it. And I didn't mean it like I thought you were singling me out. I'm sure there are tons of people in my situation....seeing something awful, wanting to report it, getting stuck between a rock and a hard place. I was just mentioning what I did because I hope you understand that it's hard from MY position to just come out and report it, especially if it's a person you like and/or has done a lot for you. I don't expect his certs to be pulled and him flogged with a CCR-hose every time some random anonymous person drops a tip, but it's just tough.
 
Maybe this is a stupid question, after all it's the USA... but is it possible to be sued for stating something that happened in a public space and in view of other people, for which you have evidence and supported by facts (accidents and deaths in that place, diving standards, etc)? I guess one can get sued for anything, but would this be a real concern or would it be an easy case to defend against?

Can you be sued: Yes.
Can you defend: Yes.

Will it cost you money - yes it could but a good attorney answering should be cross claiming for a frivolous action & costs.
 
was reading this thread and had a question -- was a copy of the letter sent to the managers of Vortex? If untrained/undertrained divers are going into the actual cave areas, it's something they should at least be made aware of since any accidents that would result from it may leave them liable. they then can make the call to allow/disallow whomever the "instructor" is to continue to lead people into vortex, yes?

One of my dive buddies testified to an agency recently about an instructor breaking standards along with at least 1 other person-- not sure maybe more. Only thing that happened was he was banned from a dive site in which the instructor had some control over.

I would like to know what agency and exactly what the witnesses actually testified to. I'd like to know more about it, but do not need to know names of people. C'mon James...give it up!! :D
