My husband was sued once. One of the passengers on his dive boat got seasick and although he was repeatedly told not to go down to the dive platform while they were under way, that's where he snuck to go vomit. His thumb got under the ladder and was broken. The guy sued my husband, the marina where he kept the boat and the dive shop where he booked the trip. The insurance company paid him over $50,000 and then promptly cancelled the policy. He got out of the dive biz shortly after that.

For example, in the case I mentioned, the plaintiff will end up paying the attorney's fees for both sides if they lose the appeal. In the unlikely event they win, the defendant's attorney will not get paid. He does not have deep pockets. The plaintiff is a rather large corporation.
