Heh, one could argue that the structure is no longer the Gulf State Park Saltwater Fishing Pier, but is simply a collection of pilings and/or rubble.....

I'm sure as soon as the new pier is completed that the law will effect that new pier.

(The old pier they said in the link that Gary provide will most likely be sunk as reef/habitat near the old pier as permits allow).

I've seen boating laws enforced at other piers in other states. A jetski ran real close across the end of a pier and speed around the corner coming close to a fishing pier. In North Carolina (just like Alabama) it's against the law to harrass or disturb fishermen or to impede their fishing. A conservation officer was on patrol on the beach in his truck and saw this happen. He got on the PA system of his truck and said "If any of the fishermen on the pier had their lines run over by that jetski, raise your arms". About 20 of them raised their arms. The conservation officer chased down the jetski down the beach, hailed him on his PA, the guy came in and he wrote him a ticket.

Fishing is big business in most states. Alabama included. Fishermen easily outspend divers a 100 times (or more). So I'm betting that law will be enforced on the new pier.

Don't get me wrong, leagal or not, I have no intentions of ever diving a working pier. I'm thinking a 1 oz sinker to the back of the head, or a treble hook in the face is not very fun. I am however interested in diving the remains of the old pier.

About 2-3 weeks ago we were snorkeling-spearfishing at the remains of the old pier and some of those construction workers called the marine resources officer on us. He shouted at us through the megaphone from the shore, that we need to get out of the water. We were at the very end of the old pier. He said that we cannot dive there, because that construction worker said it is dangerous. We had the flag and were keeping ourselves on the right side of the old pier swiming to the very end and than stayed in the middle of the pillars all the time,so what dangerous was he talking about? There was not any restricted area lined with buoys or the tape. There was not any movement of the boat, barge, crane etc. After checking our spearfishing licenses and saltwater fishing licenses(now you need both for spearfishing-new law) he did let us go

Heck in 12 feet of water you can free dive all day long...

Is there ANYONE who has been on the old pier with a speargun? what does an AL fishing license cost?

Wow.. didn't see that post. Jan 1974.. How was the fish around the pilings? and did you get to complete your day in the water or did you have leave?

I would imagine that danger he referred to is because of the structure's possibly weakend state because of the damage that was done by the hurrican that took out sections of the pier.

What the hell ever, whats there will stay until the next storm. :p I've spearfished the pier on many occassions, its produces.

Then what danger would you propose he was speaking of? I was only offering a suggestion.

I don't doubt the structure produces good fishing.
