I'm shortly going to be studying for my divemaster qualification, and i was just interested if anyone could enlighten me on my legal qualifications, if im not working, but simply on a boat as a client or diving with friends. I will obviously feel morally obliged to take any course of action withing reason to resolve any problems, however, i ams till a student and will not be getting a job as a divemaster for at least a year or so, and i was wondering if i might encounter any problems in the meantime.

I think when you come to the conclusion that you could be sued regardless of your actions, you just do what your moral obligation will allow.

I never worry about it because it wouldn't change a thing, and I don't live under a constant fear of being sued.

maybe it comes from not having anything to begin with but debt, so I guess I'd welcome someone taking some of that from me

I'm sure we could come to an out of court settlement. LOL

Look at it this way
1-[FONT=&quot] [/FONT]If you’re on a boat and someone needs help are you going to refuse it because you’re on vacation?
2-[FONT=&quot] [/FONT]If you are in the water and see a problem will you turn your back because you’re off the time clock?

I know the answer as well as you.

Basically, you have the responsibility to help people when they need help and do what you are trained to do in any situation whether it is life saving techniques, rescue, CPR DM or whatever. If your CPR trained and refuse to do CPR you might be liable if you’re sued. The real question is would you offer CPR when needed and if not why did you train in the first place.

I am in DM apprenticeship now and if someone needs my service in the water, on the boat or in a pool I will offer the help so legal issues is not a concern. If I weren’t in it for the purpose of my passion I have no business getting DM certified in the first place. Part of diving to me is the camaraderie and along with that comes helping others and having fun.

I have a hunch your over thinking this as you will be the first to help if help is needed so its all a mute point.

I am a trained Jeep Jamboree Trail Guide where we take 12 to 15 jeeps through deep woods conditions, rock climbs, etc. Even though we are trained guides, have first aid certs, tons of offroad seminars, have insurance covering our jeep club and have everyone sign a waver, we can still be sued by ony one of the people on our trails. This has never happened in the past and hopefully never will, but the possability is still there.
You don't really think about it anyway..............

And I thought it was just america where people could sue for the STUPIDEST of reasons.

I was told in Honduras and Belize that getting a law suit into court is almost impossible. You have to actually have a valid reason.

What a concept!

How many lives have wrongly been ruined by scumbags and thier scumbag lawyers looking for a get rich quick scheme?

Oddly enough, being forced to have insurance MAKES me a viable target. LOL

It's the price we have to pay I guess to take care of the truly unfortunate accident victims in some cases.

I suppose i just have to look at it like this, ive got a far better chance of being hit by a car, and the concequances would be far worse, so its not really that big an issue. Thanks for putting my mind at ease, and being a student; staying poor could well be an option for the forseeable future.

I suppose the best way to minimise the risks is to keep up to date on training and current trends in rescue and first aid, and dive with enthuasism and regard for good practice.

Make sure that you are covered with extra insurance because of the DM liability you now carry.

this seems more on the right lines but im still pretty sure its the wrong rule
