Yes, but a boat under sail does not have the "right of way" over a boat which is dead in the water. I put it in quotes because ROW doesn't really apply if both boats are not under way.
I never said that a boat under sail has the right of way over a boat under power.... I was just answering the question of when was the last time you saw a cat under sail instead of under power.

As a boat owner, I know the ROW rules.
 
Sad, Fury at legal fault but La Nina at moral fault.
I don't know the facts of this incident but legally almost in almost all vessel collisions the courts assign at least some fault to both. It's not like with auto collisions where usually one driver is determined to be solely at fault. Regardless of which is the stand-on vessel, the rules ultimately require both to act as necessary to avoid a collision.

It was someone else's question, not mine. I have seen the Fury boats to apparently be under sail many times.

In this case it was like a car hitting another car that was parked with no one behind the wheel. IANAL but I would be surprised if any fault were to be assigned to the dive op.
 
I often have the mainsail up with the iron sail (aka motor) also going. I strongly suspect that's what the Furys are doing as well.

My bet is they raise the sails for the appearance to customers while relying on the engines.
 
They have their Main sail on boat up to give them a boost and save fuel. They don't fly their jib or a spinnaker.
 
Wow.

And we all think a SMB means we are safe. How many of us are mentally prepared to be down 15 feet with 10 seconds notice while floating on surface?
 
The boat captains trust each other not to run them over when they are dead in the water.

That right there is the problem - I gotta believe Nivo would have never let someone run him over....

It also significantly reduces roll which makes the landlubbers customers happier and less likely to become seasick.
