I have been writing curriculum for a PADI distinctive speciality titled PADI Underwater Ninja. It should be approved any day now, and then my 1st class will eliminate the offending server therefore restoring honesty, balance and honor to the internet.

Seriously what can PADI do besides send a letter/call and say take it down or we will sue you? What if he doesn't? Send the PADI police to Cancun to kick in doors and seize computers?

Even the biggest PADI hater here would probably agree that PADI has sent communication to take down/amend the website

You get that approved and you are going to make a stack full of money. I am working on one called PADI Super Hero Diver. You jump from a chopper in full gear (the Australians already have that as a PADI specialty). Then you rescue a Jessica Alba type diver on the surface doing a full unconscious diver on the surface routine. Then we come along with a RIB and take her on board but you get to swim in to the beach, cross it and WITHOUT MISSING A BEAT OR HAVING TAKEN OFF YOUR EQUIPMENT YOU WALK TO THE NEARBY 5 STAR HOTEL, DO A DSD IN THE POOL AND YOU FINISH OFF DRINKING A MARTINI NEXT TO THE POOL and trying to look elegant in your neoprene.

Because we all know every hosting company is ethical and truly cares what is posted on their servers. Give me a break.

Of course not.

Im saying:

1. There is a ton of garbage and illegal ads, products, and material on the internet. If you dont know that then I have a million dollars in a bank account in central Africa. If you could send me $5000 to clear it from the bank I could....
2. It is impossible for anyone, even almighty PADI, to police the internet.
3. It is up to the individual to do some research, especially when it comes to purchasing a big ticket item such as an IDC, auto, computer, whatever,... to do their research and find out what it is legit and what is a scam.

I do understand the internet has a lot of garbage. My point is that PADI is a large, rich company (according to many) and they should have a vested interest in their copyrights. As such, to protect themselves they should have a mechanism in place to deal with these types of problems, at least for sites that are for members that have been suspended or expelled. I would think that they would have lawyers in place that can deal with even unscrupulous hosting companies, who can be sued for hosting a website that is infringing on their copyrights. Do you think an unscrupulous hosting company wants to go to court or just remove the offending site?

Of course the bad hosting guys can just run away and set up again but that means taking down the other sites they are hosting off the net for a while until they get set up again under a new name. Worth the hassle for one site?

This discussion has turned ridiculous. Of course PADI could shut this guy down if they wanted. Contrary to what some apparently believe, Mexico is not a lawless nation. Mexico is a signatory member of many international treaties covering intellectual property rights such as trademarks. All it would take is a call or letter to the right people and Mexican authorities would take the guy down, unless the CD has friends in high places. These aren't the local cops who can be bribed, either.

As for the hosting company, most are quick to respond to intellectual property violations because they can inherit the liability of their customers otherwise. If in a nation that is a party to mentioned treaties they can incur huge expenses. There is a reason you won't see many porn, bootleg softwarez, and other illicit sites ending in a .mx domain. Most of them are located in countries not a party to the treaties or that turn a blind eye, like those in Eastern Europe or Asia.
