No, they shouldn't need to be affiliated with a shop.

By no means should an instructor have to be attached to a dive shop to certify people.

it's not the shop that certifies people, it's the instructor

(i think we've lost our perspective here)

btw, the best instructors i know are independent

No, an instructor shouldn't be required to be attached to a shop. They should be able to get certified as an instructor and teach as an independent, or sub-contract to a shop or number of shops.
