Not one mention in the story that the "activist" is associated with the sea shepherd wacko's that ram fishing vessels in open water. What a load of crap. If they would have left the guy alone none of this would have happened. Sea shepard people are terrorists using the guise of environmental conservation to justify their actions.

Yes he shouldn't have pulled out her regulator. However, If they would have left the guy alone, letting him do his job to feed his family, none of this would have happened. Period.

The ends do not justify the means with these extreme environmentalists.
 
On the upside, it appears that Hawaii HB511 is making good progress to prevent further incidents. Measure Status


Since they have decided this guy is a terrorist, I'm surprised they didn't take him to gitmo for "questioning" about his fishing habits.
 
HB511 is going to make for an amusing test-case if it actually becomes law, particularly with the First Amendment questions it poses making it likely to wind up in front of the whacky Ninth Circuit.

Who cares who the activist is associated with. Did any of the incidents you mention happen when the perp made his "terroristic threats?" Were any of incidents you mention involve the perp? To my knowledge they were not, that is why they were not mentioned as they have no direct bearing on case. They might have some bearing on the overall discord between fish collectors and other people but that is another story.

Pro-hunting? Pro-filmmaking? Some narrower reading?
 
The Ninth Circuit is not known for either a pro-hunting (or much else generally thought of as being conservative) stance nor a propensity to engage in narrow readings of things like free speech rights. About the only section of the Bill of Rights they aren't consistently in favor of applying as broadly as possible is the Second Amendment.

I haven't looked at their take (if they've decided such a case) on regular old hunter harassment laws though. The problem here is that fish being fish, standard first amendment activity like filming a fish collector in public waters could be prohibited because any other human presence nearby could effect the fishes' behavior. The latest draft of the Hawaii bill wisely added an intent element and a "reasonable distance" for photos/video exemption, though, so maybe that's enough to let it wriggle past strict scrutiny.

In fact, many incidents were mentioned in the case. There is a long history of harassment by these environmental groups. Many involving the so called "Victim" herself. However, that was not mentioned in the poorly written article. That was my point.
The "perp" as you call him, is guilty for falling for their trap.
Once again, he should not have pulled out her reg.
