There is language sonmewhere saying anything above like 23% must be O2 leaned. It is aludicris position to take by the Regulator. The reg use to say any content bove 20% required o2 cleaning till they found out that air is 21% and that all gas stations would have to o2 clwean the tire fill machines. Most do not agree with it nor comply with it bt there are those tht do. There is much discussion is the areas of comercial vs personal use filling and transport. For instance a shop can not fill your hydro expired tank but you can without any violation.

What are you talking about??? If a facility has banked nitrox , lets say 32%, then O2 cleaning not necessary. This way 100% O2 is never introduced into the tank. If partial pressure method is used to create nitrox THEN tank must be O2 clean..
 
Anyone reading that letter needs to start with a look at CFR 171.1(d)(6): "Functions not subject to the requirements of the HMR...transportation of a hazardous material in a motor vehicle by an individual for non-commercial purposes in a private motor vehicle, including a leased or rented motor vehicle."

I'm very curious about this. Who will do the fine? Which government organization? Does this organization perform regular inspections in order to catch infractors and slap them with a fine? What do these inspections look like? Will the inspector park in front of the LDS waiting for a customer to bring in a tank without a Nitrox band? What happens next? Does he then walk in hoping to catch the culprits in the act of filling the unmarked tank from a bank of 32%?
 
This whole mass of confusion is a great example of one of my favorite (albeit apocryphal) legal quotes: "[Name of pompous tin-badge bureaucrat here] has made his decision; now let him enforce it!"

The DOT can issue fines as well as OSHA. But the worst issue is probably getting caught by one's insurance. Policies can have certain requirements. However, the chances of an inspection are probably not going to happen until there is a complaint or issue.

Yeah sure lots of places get away with it but as a friend said we all do dumb things and most of the time we get away with it but when we don't we are usually dead or worse*. In this case though it will probably be the poor sap filling the cylinder rather than the cylinder owner.

*Worse as in drinking yer beer through a straw and not being able to wipe yer own butt.


Using banked nitrox does not require O2 cleaning. There's no danger, no fines, no problem.
 
Im talking about cylinders - a tank does not have to be O2 cleaned to be filled using banked nitrox. If you fill using partial pressure where you are putting pure 02 into the tank, then the tank needs to be O2 cleaned. The VIP sticker will be marked as such.

That's what we in the world of scuba say. The Compressed Gas Association (CGA) and others say anything over 23.5% must be O2 cleaned. Did you read post #16 above?
