Humor me, the dumb novice social media "lawyer" only admitted to the bar via the personal recommendations Do-wee, Cheatum, and How....

Is this kind of response brief common as an appeal in Federal Court?

I'm sorry, but this whole thing stinks. Up in NC, there's a company selling sanctioned equipment to Russia, and compare this to this poor schmuck selling a rebreather that *might* end up in Libya is spending 5 years in prison. Yes, he's a felon, probably tried to bypass an export (that didn't exist apparently) restriction, is arrogant, etc. but 5 years?!

Here's the story of the NC company- as far as I know- zero charges. Special Report: U.S. firm supplied networking tech to maker of Russian missiles

Is there a real government regulation/law that prohibits selling a rebreather to Libya from the US?

Yes.
Is there a real government regulation/law that prohibits selling a rebreather to Libya from the US?
There’s a list of things you can’t sell to certain countries. Not to mention he was specifically warned not to do it and he did it anyway.
