I don't think, on a conceptual level, one could say the owner of the company 'created' an unreasonable risk - the said risk is inherent part of scuba diving.

They “created” a job for uncertified divers (not even recreational certified, much less commercial dive certified) to engage in commercial diving in violation of many workplace safety laws. If that’s not creating an unreasonable risk, I don’t know what is.
