Dear Halcyon Dealers and Distributors,
I have resisted commenting on the various issues regarding the State
of Florida's case against Barry Miller. This restraint was
challenging when people were attacking Halcyon, often indicating that
we were playing politics or fabricating charges. I remember reading
notes about burning Halcyon gear as a protest and calls for a
boycott. It is sometimes hard to have people assume the worst about
you, especially given the nature of this crime. Now after more than a
year of delays and continuances, the state's case against Barry
Miller has reached its final stages. With the trial set to begin this
week, Barry used his December 13 trial management session to change
his plea to guilty on two felony charges brought against him by the
District Attorney. He has been formally adjudicated guilty on felony
grand theft one (theft of over $100,000) and felony grand theft three
(theft of services/fraud) for his crimes committed against Halcyon
Manufacturing. Sentencing has been set for January 26; the sentencing
guidelines include the option of incarceration for to up to 35 years
in state prison. While we remain uncertain what sort of bargains will
ultimately be struck, I felt that it was useful to clarify that this
case had nothing to do with fraudulent claims or "politics."
On both a personal and professional level I look forward to putting
this behind us and moving beyond this difficult year. I would
personally like to thank our dealers
and distributors for supporting Halcyon through this difficult ordeal.
