This ain't going anywhere, as far as litigation goes. It's a matter of opinion, probably not lies and slander, and there certainly are no visible "deep pockets" jumping out at you in this forum.

Naturelover might consider contacting (email) some of his co-workers from the time this happened and let them post some corroboration. Otherwise, as stated earlier in this forum, the truth lies somewhere in the middle. Only a systematic investigation and reconstruction of the facts will put the filling in the pie. (That ain't gonna happen)

Also Geekdiver asked some very good question, which have not been answered.

I guess we could start a poll. Who do you believe? Naturelover or the Bobsleders?

Itbz: Answer a few reasonable questions for me, please!

Did you or did you not contact Nature Diver other than through Scuba Board about his postings, and if so - please tell us exactly how? Were attorneys involved in the communication?

Had you came onto this SB to defend yourself or argue against Nature Diver, I would have read with an open mind.

If you contacted him either with an law office involved, or in threat of one, why did you not defend yourself here first?

What say you...?

Ho, ho: If you have used an attorney, didn't he tell you to not come on here? :hehe: I'm involved in some legal actions now, and I know better than to talk to or about the other parties without going through my lawyer!

And to Nature Diver:

Scuba Board doesn't not have spiel chick, so give us a break if we can't type or spell. I am intelligent, got a Mensa card to prove it, but my typing and spelling leaves much to be desired. Ok?

IMHO, NatureDiver has every right to express his opinions to us, just as ltbz has the right to defend her dive operation against his opinions and statements, but accusations of slander and implied threats of lawsuits seem rather opportunistic. What if NatureDiver spoke about this only face to face with his friends? In that case, ltbz wouldn't even know about those comments. Where and on whom would those lawyers even know to begin to descend?

I wonder which is worse, NatureDiver's accusations of malfeasance or the resort op's accusations of slander. Both parties sound credible. I doubt that any court would rule against the operator on the evidence given here so far. That does not assume that NatureDiver is guilty either.

It's an interesting internet phenomenon that folks feel they can say almost anything critical of another person or business with impunity, regardless of how their statements may impact on the emotional or fiscal wellbeing of the subject. Sometimes the only defence against it is the threat of legal sanction.

What if everyone here accepted NatureDiver's statements on blind faith and started a huge blacklist campaign against the resort operator with no more proof than we've seen here, and after a lot of damage had been done it was determined that the complaints were erroneous, based on faulty assumptions and misperceptions?

That being said, there is a certain amount of value in threads like this. It certainly serves to remind us all of the fragile nature of some of the flora and fauna in the oceans. But there comes a point beyond which criticism turns into kangaroo court and when that happens there's often an undeserving victim. So don't lose your objectivity folks.

There is no scuba police. Or were you speaking of an industry other than diving?

If you ever dive in Cancun watch for the little yellow RIB to pull up near your drop point. Watch the solo diver with the Nitrox tank drop in and take up a position alongside your group in the water, making notes on a slate throughout the dive. Then ask the divemaster after the dive if he was written up for any infractions like one of his charges touching the coral or not having enough supervision for dives within the park area.

People, please be aware of something.

Anything you say on this or any other board is classed as "The written word."

Should you say anything defamatory, derogatory, illegal or factually untrue CAN land you in court in your own country or in anyone elses.

Not only that, but the owners of this or any other board can also be held liable. They will have board shut down, the Internet Service Provider will be fined and we will be without a Scubaboard.

Case:

Recently in the UK a 17 year old girl accused six top-flight soccer stars of rape.
Within 12 hours some of the names of the soccer stars were being banded about on soccer teams unofficial websites. Within 18 hours solicitors (lawyers) for the soccer stars had issued writs of libel against the ISP, the writers of the post, and the Forum management.
All forum management closely scrutinised the posts and deleted them immediately.
It went as far as onthe next Saturday, the TV companies put in a 1 minute loop in the broadcast to edit out the fans chants about the players, because that would mean the TV company would be sued for slander.
All of the newspapers were warned, and even the usual papers who pay no regard to the legal wranglings of things like "fact" and "truth" said nothing.

Just because you are "anonymous" and write things about people and LDS does not mean you are immune.

NatureDiver should have taken these concerns to the company and not published unsubstantiated claims of malpractice on this board.
Likewise the operator should not have replied.
Both of you, IMO, have acted incorrectly and un-professionally. Some may say "illegally and with predjudice"

No sirens, and the "he" part was the boat driver. The ossifer who joined us in the water was a "she" diver. It was kinda funny. I knew who they were because Miguel (the DM) had told me, and I knew what they were watching for. Miguel's assistant was sick on the boat and wasn't joining the dive and Miguel had told me he'd get charged for not having enough dm's in the water but it was too late to do anything about it. Just for the helluvit I dropped back and took up the assistant's post as trailer and made a few officious looking pokes at the divers during the dive. I asked Miguel the next day if he got ticketed. "Nope" and then he thanked me. The marine copette didn't come close enough to identify us personally and the dm's don't wear anything particularly distinctive so mebbe I fooled her. 8)

At least from this we know it is legal to dive solo with Nitrox in Cancun....
