A rouge wave would only happen in the Red Sea.
 
Interesting perspective. Randy Jordan is responsible for the accident, yet he was not on the boat?
I don’t know any of those people but as the owner of the boat I have a hard time believing that he was unaware of the conditions at the inlet. Specifically considering the weather that had been occurring around that time.

As a boat owner I’m constantly aware of the marine forecast.

Are you serious? Owners of a business are frequently held liable for screwups by their employees. The owner is the ultimate decision maker for sending out a dive boat in questionable conditions, and is likely to get bit in the ass when clients/crewmembers are injured, especially if most other charters made the decision to cancel.

I’m by no means an expert on maritime law but I have it in my mind that the ultimate responsibility lies with the captain. I’m basing my ASSumption on the aftermath of the Conception / Truth Aquatics incident.

ETA: stuff like this is why I’m always ready to hit the water when I’m on a boat; drysuit closed and fins/mask at the ready. That would have been terrifying , my sympathies to all on board
