I’m by no means an expert on maritime law but I have it in my mind that the ultimate responsibility lies with the captain. I’m basing my ASSumption on the aftermath of the Conception / Truth Aquatics incident.
Due to the "injuries beyond first aid" this is a reportable accident, and the CG will be pursuing this - both the captain and the owner will be deposed along with all the passengers.
 
Now that a sandbar is blocking the whole inlet, and a captain has to run parallel to shore to get in, not a great decision on this capt.'s part with a single engine skegged boat in those conditions.
