Being an active dm might very well make you liable in quite a few situation imo.
You are an "inactive DM" unless you have insurance. That is, you cannot work as a DM.
 
If you are an active DM and participating in a course of some kind, then you are definitely liable. Even after I let my PADI membership lapse, I maintained liability insurance for a couple of years as protection against any potential civil suits.

But if you are just diving with a buddy or in a group - regardless of whether you are a DM or not - I suspect your exposure would be as limited as any other diver. Good Samaritan laws also come into play.
