Does anyone know where i can get regulations on diving bottles? I use mine surface only for my air rifle, i need the regulation that says bottles that are used on the surface need only be tested every 5 years, i know its true just cant find the regulation.

Tested for what? If you're talking about a VIP every year, that isn't a regulation, and makes no difference whether its used underwater or not. Surface use has nothing to do with either hydro or VIP.

If the local dive shop won't fill your cylinder without an annual visual inspection then you are out of luck.

Cylinder explosions have killed several dive shop people and they err in the direction of safety. While the annual is not required by any law, it is a common industry practice and most dive shops will not fill a cylinder that hasn't been opened up and inspected in the last year.
