Most of the problem stems from the “up to the discretion of the agent”. That is the problem and even the agent’s favorite auntie cannot give a definitive answer since there is not one. It is clearly discretionary. For me personally I won’t take the risk of not having Regulations/information generated by Customs or a government agency. But overall I don’t think visitors have the same issues. Worst that will happen to them is having goods confiscated and/or a fine. Those with properties here probably need a little more comfort. I will say that I find Cayman New Resident a fairly reliable source but they cannot define for customers what the government itself has not defined.
 
Remember, under the new policy you can go through the "green line" without having to be interviewed, but can be stopped if they deem you suspicious. So the discretion issue has been somewhat mitigated.

It's pretty much the same for US citizens returning to the US (at least for GOES travelers). I've never declared anything and I've never been stopped (although I don't think I ever exceeded the duty-free limits).
