Aqualung fins broken before even used

Bought a set of fins a few months back for my grandson but due to covid he only came around for them last week. On opening the packaging I noticed one of the rubber springs under the fin is broken

That was pretty common about 10 years ago. Aqualung was supposed to have fixed that problem. Do you think the fins have been sitting in a warehouse for the past ten years before they were sold to you?
 
The shop I bought them from did on 8 or 9th of Augbut said aqualung have not responded with a parts number and are unlikely to as they are discontinued stock.
The shop has offered to refund and are sending a returns label. It’s a real shame as my grandson wants the fins. They were at a reduced price so I suppose it’s just not worth their bother?

It’s quite possible as they were reduced in price. It’s a shame as I bought them for my grandson thinking they were a bargain but apparently not shame I can’t just get replacement bands
