So it seems you want to do Fort Weatherill if you want to live to see another dive... Got it...
A diver definitely needs to pick the right day/night/time to dive there from shore. Going out right at the point is probably the most benign spot if the water is "calm" and the tide is slack. Calm being >2' surf, just be ready for the possibility of 4' surf coming out! A tricky place which is why I always caution people that want to rock hop there. The only thing the conditions there don't hamper is Murphy.

Comes from fear of divers poaching bugs at night from pots. RI is shellfish, no night time shell fishing. Fishing polluted areas at night was a big thing at one time. Lots of shellfish in those areas.
A DEM enforcement officer informed my buddy after checking his bag post night dive that his bugs were all good size but the six mussels in there constituted a felony! He told him to "release" them back into the water.
Depends what is important to the State's economy. Consider yourself lucky you don't live in Maine. Maniacs don't allow diving for bugs at all.
