State and national parks excluded, has anyone been hassled by law enforcement while metel detecting in a lake, river, or beach? If so, what was the claimed offense? I have never been questioned yet.
 
You need to look at the Texas Antiquities Code. It is my understanding that if an artifact was produced/discarded prior to 1899 and lies on public land or ROW, removal or disturbance is prohibited. Most creeks, lakes and rivers are considered public ROW. The sole exception are those flowing through Spanish land grants with vested water rights.
