I have seen the literature from xs scuba. They are allowed to send tanks as "new" up to I believe 12 months after the born on date.

Well, I went ahead and and got an XS Scuba X7-120 at my LDS. It was the one I mentioned eariler that is about a year from the born date. I asked them to set it up for Nitrox and they said it wouldn't cost me any extra. So, with tax I walked out the door spending $427.95 on the tank and Nitrox setup. I didn't think that was too bad at all.
The shop owner wasn't there so I couldn't really ask for air fills too, but still think I made out pretty well anyways.

That is a very reasonable price. The extra capacity is great for long nitrox dives.
