fpoole, I think the real issue is if the diver in 006 sees your sold work, in an advertisement perhaps, and can prove that he's the person in the sold photo; then if he wants to sue, you are up a creek. Possibly owing more than the image was sold for.

Even if it's a generic backlit-shapeless blob-even their own mother couldn't recognize them, if it's them, then you could owe. Or get a model release and not owe.

So is it because he is by himself, singled out? would that be the reason he'd be able to collect?? If he was in a group shot as a "Blob" but Mom or himself could prove it was him the I'd still be up a creek??
How do all the Generic photos of scenes in a place or market place work it out... what protects them, being in the "Public"?

My understanding, but that's why I'm asking, is that if out in the public, like the Movie Stars Paparazzi (spelling?), how do they get away with it...
