Following the drowning death of Mr. Wesley Skiles, a famous underwater photographer, his wife filed suit against multiple parties, including Mark Derrick, Dive Gear Express LLC and Fill Express LLC. Unfortunately, the newspapers and scuba blogs printed the bald allegations against Mr. Derrick and his companies, perhaps leaving some with the impression that he was guilty of conspiring to spoliate evidence or misrepresent facts regarding the equipment at issue. We are now pleased to report that after Mr. Derricks deposition was taken and the facts of the case were made known to all parties concerned, Mrs. Skiles dismissed all counts of her Complaint against Mr. Derrick, Dive Gear Express LLC and Fill Express LLC with prejudice and with no funds being paid to the Skiles family. Mr. Derrick hopes this updated information will set the record straight and repair any damage that his reputation or that of his companies may have sustained as a result of the filing of this lawsuit. Mr. Derrick was defended in the case by Mark Hruska, an attorney specializing in defense of dive-related wrongful death, professional negligence and products liability claims.
