Arnaud, the courts don't agree that they've become the equivalent of a town square. The court's look to private ownership, and then principal purpose. The principal purpose of a mall is selling stuff for which you could find a better price on ebay.

No, Cherry, but you get an insight into the demented, hair splitting minds of lawyers. Yuck. If I'd only stayed on with waiting tables for a living . . .

BTW, in France, any place open to the public (malls, restaurants, clubs...) is considered a public place, regardless of the ownership. Problem is, we don't have the First Amendment...
