If you buy something that isn't as it should be you must give the seller a chance to rectify the problem. He should have sent it back to be fixed or for his money back.

This guy is keeping an item he hasn't paid you for. You are getting robbed.
I agree... that now makes him a thief.

But the OP refused to take it back and return the money so he has a broken bottle and the OP won't take it back. Told him it was as is with no warranty AFTER delivery and AFTER telling him that it was very useable.

However agree that now that he has his $ back he has to return the unit. To not do that is theft. He should not have repaired the unit and kept it.

Neither party in this is someone I would want to deal with.
