I don't see anything in the PMs posted that says "as is" or in any way says there is no warranty or guarantee. There was an explicit statement that it was working as it should, and it wasn't even couched in "I think" or "to the best of my knowledge".

The buyer is the credit card company's customer, they are going to side with him over you. You could file a small claims suit against him and get a more objective ruling but I think you would still lose.

You should request the buyer to send you $41, which is the difference between the $113 he agreed to pay for a working unit and the $72 he has actually paid (to the shop) to make it a working unit. The buyer is actually better off than if the unit had worked in the first place, since he now has a unit that has been inspected by a shop tech and can be more comfortable that it is in proper condition.
 
Why should he? If I were him, I'd start up a new web site:

And post all the details that I could.


So you wouldn't mind if someone posted your families address, phone number, etc. on the internet?
It is generally considered proper board behavior to cover up the phone number and address.

I think this is the most fair answer. You sold him something that didnt work, he has something he didn't pay for... meet in the middle and move on. I am glad his name and address is gone that is crap to leave that out on a public forum like this.

I sold it as is with no warrenties expressed or implied he paid via paypal and once he recieved it he left postive feedback on the scuba board, after about 2 weeks he contacted me said it was a useless paperweight as he had tried to use it at a depth of 10ft. and got a mixture of air and water, ... I then called his number and today I got the pm stating he had the unit repaired and has dove it several times and that beings his credit card company had found in his favor he was not going to return it, ... Any thoughts on this?
Yeah, I have a thought. I wouldn't want to do business with either one of you.

I didn't realize a couple of the pm's were not pasted, here are the 2 that did not paste, please see that the buyer even says he knew there were no warrenties in the second one.

The bottle was fillable and it did breathe but, as I had told him I never took it to open water only tested in the old tank.

I have tried to work it out and he basically said that it is his to keep as his credit card company found in his favor, I consider him a thief and have no remorse in posting his personal info., maybe bad on my part?

I know the spare air was working when I sold it too him, funny how it now is repaired and works.

I tried repeatedly to handle this outside the forums he even initially wanted to let the Scuba board decide but, I wanted to handle it between us, now he has chosen to keep my property, he said it was useless, but even the fill adapter was worth more than $40.00 on ebay and I had a buyer who I told the whole story too who wanted to buy it for a $100.00 and have it rebuilt, bottom line I feel he got his money back and never had any intention of returning as he said the only message he got back from was a few weeks ago and since had it repaired?

Call me frustrated.....................
 
What I don't understand is, if paypal sided with you, and his cc company sided with him, then it's paypal who should be eating the costs here, not you. How does that work? I thought paypal was safe, but if all a buyer has to do is initiate a charge back with the cc company, then it's not safe at all.

I've learned a lesson here - for any amounts of real money, I guess it's back to money orders for me. Screw paypal.

On a related note - bane, I know you got screwed. But, you know what? It's a small amount of money. Consider it lesson learned, put up a website saying you got screwed, and then let it go. The stress and negative feeling just isn't worth it.
 
I think he had the opinion that you took advantage of him and now he feels he is justified in stealing from you. In the end, you were both wrong at some point but right this minute he is the one acting the thief. You both could have handled it better, but he is firmly in the wrong. Buyer beware is always the buyers responsibility...if he wanted an inspection and return policy he should have stated as much up front. I always do, and I always offer same when I sell something.
