- the LCD touch screen is useless underwater (does not go over 10 feet depth, as written in the package rather than in the user manual), had to return it, could not find an LCD screen without touch not sure it exists anymore

I don't understand this - you can't use the touch backpac over 10' because its just a thin plastic film but you can use the screen with the rigid back it also comes with, down to 60m... You can do everything from the mode button in front of the camera. Just like the old non-touch LCD backpac on the H2 (which also works on the H3 incidentally).
 
$70 direct from GoPro. Even less on ebay.

Craigslist is a good source too, I was able to fetch one for $40 from someone that was feeling an utter need to upgrade to the new touch LCD backpack. There's a whole bunch of people wanting to "upgrade" their HERO2 for the 3, so there's plenty of offer.

Also, I would consider this as one of those impulse purchases; GoPro's videos look so damn awesome that only after people buy that they realize that they don't really base jump or ride a dirt bike - and it's up for sale again.
