If the OP was trying to blame the LDS for only having two tanks instead of three for the dive then those saying he is at fault may have a point. That does not appear to be what happened, the OP took responsibility for only having two tanks that day and simply wants his money back for a tank he cannot use due to a defective O-ring.

The LDS should have refunded the tank cost.

This is how I see it.

You are both at fault to a certain extent, but the dive shop should not be letting out gear like this expecially when the repair costs pennies.

Their consequence should be refunding your money.

Your consequence should be the lost time and gas, and a dive.

what if you rent the car and half a day into your drive the engine quits on you and just won't start.

you call the rental company and they say "your problem. you should have checked the engine."

I stated from the outset that the shop is in the wrong. I'm not defending the shop. I suggested the OP dispute the charges. My only point with the car analogy is that the diver *could* have averted the situation by checking in the shop rather than being surprised in the field. I can't put my finger on it but I can't stop feeling that there is more to the story than we've heard.
 
Yep, I could sit there and rent (or sell) broken merchandise all day long, all the while telling people it worked, but I wouldn't be in business for very long.
 
the shop owner is responsible for his rental equipment, all of it, the tanks, the air in them .. what about a regulator? in what kind of shape are you willing to take one? what kind of spare parts should you have?

he has alienated a customer and over what, an O ring? ... some air??
 
I'd like to know the name of the dive shop. The internet is a pretty powerful thing...

The fact that he is a divemaster is totally irrelevant. He could be the Supreme God of SCUBA and it wouldn't make a difference. Businesses have a responsibility to provide their customers with a working product.
This is not an H2andy issue....
