CA DFG is changing the regulations for 2008 in regards to Spiny Lobster.

Here are the proposed new regulations.

Section 29.90, Title 14, CCR is amended to read:
§29.90. Spiny Lobsters.
(a) Open season: From the Saturday preceding the first Wednesday in October
through the first Wednesday after the 15th of March.
(b) Limit: Seven.
(c) Minimum size: Three and one-fourth inches measured in a straight line on
the mid-line of the back from the rear edge of the eye socket to the rear
edge of the body shell. Any lobster may be brought to the surface of the
water for the purpose of measuring, but no undersize lobster may be brought
aboard any boat, placed in any type of receiver, kept on the person or
retained in any person's possession or under his direct control; all
lobsters shall be measured immediately upon being brought to the surface of
the water, and any undersize lobster shall be released immediately into the
water.
(d) Report Card Required: Any person fishing for or taking spiny lobster
shall have in their possession a nontransferable Spiny Lobster Report Card
issued by the department and shall adhere to all reporting requirements for
lobster defined in Sections 1.74 and 29.91, Title 14, CCR.

Section 1.74, Title 14, CCR is amended to read:
§1.74. Sport Fishing Report Card and Tagging Requirements.
(a) Purpose. These regulations address potential concern for overfishing and
a lack of recreational fishing effort and catch information in some or all
areas where the fishery operates. Many of these species are of high
commercial value, and therefore, additional enforcement mechanisms are
needed to improve compliance with existing bag limits and other regulations,
and to reduce the potential for poaching.
(b) Species and Location Requirements. Individuals fishing for or taking the
following species are subject to report card requirements in the following
locations described below:
(5) California spiny lobster, in all areas where take is authorized.
Section 29.91, Title 14, CCR, is added to read:
§29.91. Spiny Lobster Report Card Requirements for Ocean Waters (FG 685, See
Section 701).
9 (a) Spiny Lobster Report Card Required. All individuals must have a Spiny
Lobster Report Card in their possession while fishing for or taking lobster.
In the case of a person diving from a boat, the report card may be kept in
the boat, or in the case of a person diving from the shore, the report card
may be kept within 500 yards on the shore. Individuals must complete and
return the card pursuant to regulations in this Section and in Section 1.74.
(b) Prior to beginning fishing activity, the cardholder must record the
month, day, location, and gear code on the first available line on the
report card.
(c) When the cardholder moves to another location code, or finishes fishing
for the day, he or she must immediately record on the card the number of
lobster kept from that location.
(d) In the event an individual fills in all lines and returns a Spiny
Lobster Report Card, an additional card may be purchased. See Section 1.74.
(e) The annual fee for the Spiny Lobster Report Card is specified in Section
701, Title 14, CCR.

PERSONAL COMMENT: my personal stand on this issue is not with the report
cards it self but with some of the specific regulation.
The issues that I see coming are the SAME issues that many divers have
been preaching to us.
DFG WARDENS HAVE BEEN ISSUING MANY TICKETS IN THE PAST TO DIVERS FOR NOT
COMPLYING WITH:
1. ......the report card may be kept within 500 yards on the shore.
So many times that we have been diving on any of our favorite spots and have
wondered more than 500 yards, YES ALL THE TIME. A warden can ticket you
because you are more than 500 yards from your card.
2.......... (c) When the cardholder moves to another location code, or
finishes fishing for the day, he or she must immediately record on the card
the number of lobster kept from that location.
Card must be fill out immediately if you get out of the water and move to
another location!!!!!!
THEY CLEARLY SAY IMMEDIATELY!!!!! Means as soon as you come in contact with
shore. SOOOOOO, you have to carry your card around when diving and as soon
as you exit you better have a pen ready to complete that card right there on
the beach or on the rocks. NO waiting AT ALL.
If a DFG warden sees you changing out of suit near your car and you haven't
fill out that card, means you are getting a ticket. PERIOD.
If you got out of the water and are changing locations, may be just walking
down the beach to re-enter the water on a better spot and you are in
possession and have not fill out a card............ YOU WILL BE CITED FOR
NOT COMPLYING WITH THE LAW. PERIOD.
SAME APPLIES TO BOAT DIVERS, you must fill in those cards before moving to
another location.
Example
You dive DIVE SPOT A and get lucky with a small LEGAL Lobster and decide to
move to DIVE SPOT B, you are suppose to fill out that card IMMEDIATELY as
soon
as you come into the BOAT before moving to Bird Rock. If you get to Bird
rock and a DFG warden happens to check your card and you have not recorded
that lobster, guess what.......................
YOU ARE GETTING A TICKET...... PERIOD
